Board of Health Considering Proposed Smoking Room Regulation
The Cascade City-County Board of Health will consider a proposed regulation governing smoking rooms at local business establishments during a public hearing this coming Wednesday, June 3, 2015. Due to the public interest in this issue, the hearing will be held in the City Commission chambers commencing at 11:30 a.m., as the first portion of the Board’s regular monthly meeting. The public is welcome to attend and comment on the proposal. A copy is available on the City-County Health Department’s website at http://www.cchdmt.org/about/board-health/
Following the hearing, the Board will decide whether to adopt the regulation as proposed, or with any amendments. The Board will also consider an effective date for implementation of any regulation that is adopted.
The interest in a regulation has been prompted by controversy within Cascade County as to the meaning and scope of those provisions of the Montana Clean Indoor Air Act, as evidenced by complaints filed with the Board, as well as litigation and the recent Montana Supreme Court decision in MC, Inc., et.al., v. Cascade City-County Board of Health, 2015 MT 52.
